Appendix 1

In exercise of the powers conferred by section 37(1) of the National Parks and Nature Reserves Ordinance, 1998 (Cap. 27), the Majlis Mesyuarat Kerajaan Negeri has made the following Regulations:

Citation and commencement

1.   These regulations may be cited as the National Parks and Nature Reserves (Amendment) Regulations, 2010 and shall come into force on such date as the Minister may, by notification in the Gazette, appoint.

Amendment of regulation 2

2.   Regulation 2 of the National parks and Nature reserves regulations, 1999 (Swk. LN 63/1999) (in this referred to as the “Principal Regulations”) is amended by inserting in the appropriate alphabetical order the following new definitions:

       “adventure caving” means walking and or climbing in areas which are largely in their natural state no or very little basic facilities and which requires physical challenges to reach the destination;

      “adventure trekking” means taking part in caving activity at areas which are largely in their natural state having no or very little basic facilities and which requires physical challenges to reach the destination;

         “children” shall have the same meaning as in the Child Act 2001 [Act 611];

      “commercial filming and photography” means any filming or photography principally intended for public viewing and financial gain. Commercial filming includes advertisements, feature films, TV drama, documentaries, educational films and non-government sponsored filming and tourism promotions. Commercial photography includes images for magazines, postcards, promotional of private events or products;

      “disabled person” shall have the same meaning as in the Persons with Disabilities Act 2008 [Act 685].

          “leisure trekking” means walking in areas which have basic facilities provided and this does not require physical challenges to reach the destination;

          “locals” means Malaysians and it includes permanent residents;

      “motorized equipment” means any equipment with a motor and it includes vehicles, outboard engines, generators, grass cutters, aircrafts, jet skis, paragliding and others;

      “World Heritage Site” has the same meaning as that given by the World Heritage Convention.

Amendments of regulation 3

3.       Regulation 3 of the Principal Regulations is amended –

       (a)    by adding the words ‘and other charge’ immediately after the word ‘entrance fees’ in paragraph (1);

           (b)      by inserting immediately after paragraph (2) the following:

                 “(3)  Notwithstanding paragraphs (1) and (2), the Controller may at his discretion, waive or vary the accommodation charges, park guiding fees and other related fees and charges prescribed in the Second Schedule”.

 Amendment of regulation 6

 4.     Regulation 6 is amended –

         (a)    by deleting the full stop after the word ‘cancelled’ in paragraph (e) and immediately adding the word ‘or’;

         (b)   by inserting the following new paragraph (f):

         “(f) is bringing in motorized equipment without the permission from the Controller or Chief Park  Warden”.

 Amendment of regulation 7

5.      Regulation 7 is amended by substituting the words ‘to a park guide according to’ in line one of paragraph (2) with the words ‘for the service of a park guide who is the employee of the park management authority in accordance with’.

 Amendment of regulation 8

6.       Regulation 8 is amended by substituting the second sentence in paragraph (1) thereof with the sentence ‘The licence shall be in Form C of the Third Schedule’.

 Amendment of the second Schedule

7.        The Second Schedule is substituted by the new Second Schedule;

 Amendment of Third Schedule

8.      The Third Schedule is amended by inserting immediately after Form B the following new Form C:
